    Unhappy Help!!!!

    Hello Ladies and gentlemen, I am hoping that you can help me my husband is in the middle of apllying to the NZ army from the brittish so we will be looking to immigrate via SMC catagory however we have a probelm my horrid ex husband who has not seen my son in 18 months dumped us in Northern Ireland before continuing to reside in England has decided that he doesnt consent to our immigration therefore we have placed papers in court. Other issues include dosmestic violence (Verbal), the fact that when my son was in his care at two year old my son was found wondering the street (i was away on a residential course for work) and issues of gambling/drinking on social work report from 2006 when we were married should i bring this up at court or will it only delay things we have a clock ticking..

    So we are now seeking permission through the courts we have a very tight time frame of 12 months from when we recive my husbands job offer to being resident in new zealand to take up the employment therefore are asking for leave to remove/residence and change of name all at once our main problem is how the process works wether it be heard in family court or county court there seems to be mixed views and other problems along the way can anyone be of help please!!!

    I am pulling my hair out......

    I'd suggest that you are in a bit of a unique situation, and so contacting NZIS in London directly would be very much the bast way forward. If oyu can get there in person and discuss with an officer face to face that may be easier all round, and they are VERY helpful.

    I entirely agree with Duncan. Your situation is right out of the range of experience I've ever seen mentioned here, sorry.

    Also, the issue of going to Family Court or County Court is likely to be beyond any advice NZIS can give you - have you got solicitors advising you? They're the people most likely to be able to tell you the sort of time-frame you'd be dealing with on that point.

    I have got a solictitor at this point - grudging every penny mind you we are due for a directional hearing 10/03/10 we realise it can go many diffrent ways but have been told to put the standard folder together and collect as much info as possible just wondering who had successfullt won leave to remove to New Zealand and what information sources they included in terms of schools etc

    Just wanted to say that I hope it works out OK. I think solicitor is your best bet at this stage.

    Oh dont pull your hair out, im sure it will work out. Is he doing this for badness?, is there any way you can both sit down with maybe a family friend and chat about it together and come to a more reasonable solution, best wishes to you

    Thank you all, Tess he doesnt live anywhere near us and yes is doing it to be a shear rotter i have calmed down a little from when i first posted and i am doing everything i can hoping this is sorted out was just looking for anyone that had gone through Leave to remove and what there outcome was where it was heard etc etc

    does he live near me and i"ll go and pull his hair out LOL, is there an age whereby you dont need his blessing to remove your son, have you had a chat with citizens advice..free
