90 Day Trial Period

Hi Guys

Can someone advise me whether the 90 day trial period applies only to Employees? i.e.

From 1 April 2011, a new employer can provide you with an offer of employment which includes a trial period. A trial period is voluntary, and must be agreed to by the employer and employee in writing in good faith as part of an employment agreement.

But can it apply to an employer i.e. if an Employee finds the work environment not as per his/her expectations or they have started work in Company A but a week later receive a better offer of employment from Company B (benefits and salary). Can they also terminate from the employment in good faith during the 90 day trial period.?

Please advise.

In addition to the above ... This previous thread regarding the 90 days trial period http://www.enz.org/forum/showthread.php?t=38937 ; have there been any changes in relation to applying for residency?

And to add on to the same topic.. Even though you do apply for residency within the 90 day period.. your selection from the pool is only made.. but by the time everything is processed and a decision made.. you are likely to have completed the 90 day trial period.. so there should not be any condition on the visa really if there is any in relation to the probationary period.

Re: your first post, I think it would depend on what exactly is written in your contract. The wording quoted here is all about what the employer can do, and doesn't mention any rights given to the employee, but there could be another paragraph as well. Contracts aren't all the same, and you'd have to read the small print on the one offered to you, to see what was included.

Re: your second post, I think you're right - if you'd already done the 90 days, INZ are very unlikely to put a condition on the visa.
