    Default Partnership based work visa extension

    Hello everyone,

    I am a New Zealand permanent resident and my partner's partnership-based work visa 1 year will expire soon in December 2020 a partner and we are planning to for a work permit extension and start the process on a resident visa

    We live in Christchurch but now she got an offer in Auckland.
    we have been living together in NZ since Aug 2019 (well over a year). the main issue we are facing now is that I have a permanent job here in Christchurch but will be planning to move back to Auckland which will take some time, we both need to stay in different cities for some time.

    how long can we both stay apart and maintain our relationship? iam not sure when can I get a job in Auckland with the current situation.

    also, I am wondering if we apply for work extension and the visa didn't process on time ( 20 Dec 2020) does she get an interim visa with a work permit where she can work?

    The length of the separation is not the only factor: the reason for the separation and how you maintained your relationship during separation will also be considered (F2.20.15(b)) when the assessment on the genuineness and stability of the relationship is made. Ultimately, there can be no limit placed on the length of separation (and the operational manual makes no attempt to define one): it's really down to the strength of the relationship itself at the end of the day.

    An Interim Visa is issued to an applicant for a further temporary entry class visa where the previous temporary entry class visa is about to expire: see this factsheet. Note that Interim Visas are not issued to applicants for a residence class visa (unless they also have a further temporary entry class visa in progress).

    The full matrix of Interim Visa conditions may be found here. Reading this, it appears that, assuming that your partner currently holds the Partner of a New Zealander Work Visa, your partner must apply for the exact same visa (i.e. another Partner of a New Zealander Work Visa) for the Interim Visa to have work conditions; any other visa application will result in the Interim Visa having visitor conditions.
