Yes it is and you both have to have a taxable income.....
it also seems that if the fees are in fact "donations" then you can claim the full 33% uncapped. what is the criteria? the childcare provider is an NPO but doesnt seem to know!

This is the whole school donation issue. One of the reasons the fees you pay to schools are called 'donations' rather than 'fees' is so that you can claim the tax back on them.
If you have children at school, and have paid the fees, then the School normally sends you a receipt that you can then send off to claim the tax back. If they haven't sent one just pop into the school office and ask for one.
However, by calling them donations, many parents then feel they are voluntary and don't pay....

There is a donations section where you enter all charity donations. So along with the usual things we consider to be charity payments..... like donations to the Earthquake appeal......if your school, kindy, after-school programme designate any payment you have made as 'donations' you can enter them there.
Then there is another section for Childcare payments, which you can use if both parents are working a certain amount of hours. And this is where you'd enter any standard chilcare payments.
thanks eternalkiwi... ive just had a good fish about and discovered they are a registered charity and have donee status. does this mean the "fees" are in fact donations and can be claimed back at 33% with no cap until my taxable income rather than the £310?
