    Post conditions under section 49(1) immigration Act ?

    hello , has any one who applied with points less than 140 without job offer got Resiedence visa ?
    if yes does it come with conditions under section 49(1) immigration Act ?
    if yes what are the conditions ?

    From my limited knowledge on this, I reckon 49(1) is applicable for applicants with job offer (job offer automatically bumps up some points).

    However there cane be other reasons for Section 49, while someone reverts back you can search for "Section 49" and here is one thread that might be useful

    There are many people who have gained Residence with less than 140 on their EOI originally.

    Section 49(1) is what I was talking about in an answer to you on another thread, and Sun777 is quite right, in that it most often happens when someone has a job offer giving them some of their points.

    We applied under the SMC category with 135 points and no job offer. Our Residence Visa AIP letter had no Sec 49(1) /Sec 18(A) clause.

    you mean that the letter had no sec 49 (1) and no sec 18(A)
    mean you got residence visa with no condition ?

    Yes, no conditions on the Residence Visa.
