    Default Going Back to NZ from UK

    Hi

    I am NZ citizen living in Uk since Feb 2008, this query is about my wife visa status.

    She applied for NZ PR when we were there in Jul-2006 and she was granted PR later in Nov-2006 with PR indefinite and Returning resident visa.
    In Feb-2008 we moved to UK, so as of now her Returning visa expired way back in Nov-2008

    Now we want to go back, does my wife needs to apply for Residence permit again? OR does she needs to apply NZ returning resident visa?
    She don't have Indefinite returning resident visa.

    First thing - the names of things have changed. What used to be PR with RRV is now called Residence (with travel conditions), and PR with IRRV is now called Permanent Residence.

    However, from the INZ page quoted below, it appears that, as your partner, she will be allowed to get Residence with travel conditions (like her PR with RRV), just upon proving that you two are still together.

    Partners of New Zealand citizens

    If your resident visa has expired and you are the partner of a New Zealand citizen, you may be granted a second or subsequent resident visa with travel conditions valid for two year. You must show that either:
    you were granted a resident visa under Partnership Category on the basis of your relationship with your New Zealand citizen partner and the relationship is ongoing, or
    you were granted a resident under a different residence category, and you can provide evidence that you have been living with your New Zealand citizen partner in a genuine and stable relationship for at least 12 months.

    So based on she is away from NZ from last 4 years and 10 month, so her returning resident visa expired back in Nov-2008, so what forms she would need to apply?
