    Cool What will be the nationality of the baby born in New Zealand to other nationality parents?

    Hi Guys I would like to know,
    What will be the nationality of the baby born in New Zealand to other nationality parents who are currently residing in NZ on resident visa?
    Example:-
    Parent Nationlity -India
    Visa Status-Resident Visa.

    If that's the same as the old "permanent residents visa" then it will be a Kiwi & get a Kiwi passport as this happened to us, seemed a bit strange at the time, still does now but we have 1 Kiwi in our family

    In the link provided above, as per the blow text -
    Citizenship by birth in New Zealand from 2006
    From 1 January 2006, children born in New Zealand (or in the Cook Islands, Niue or Tokelau) will acquire New Zealand citizenship at birth only if at least one of their parents:
    is a New Zealand citizen; or
    has permanent residency (ie is entitled to be in New Zealand or Australia indefinitely); or
    is entitled to reside indefinitely in the Cook Islands, Tokelau or Niue.


    I think if Parents are on resident visa (initial 2 yrs), then child can't be awarded a citizenship. It's only after they get PR status after satisfying the conditions of 2 yrs, their child can get citizenship.

    Raj,

    I would check whether your comment about it not applying in the first two years is correct. The first visa used to be called permanent residency. The new names still gives yu, as far as I understand it, the right to reside indefinitely on arrival with a residence visa...it is just that you cannot leave and re-enter after this time. Often the names have not been changed by other govt bodies...so it is worth checking.

    If residence permit is equal to PR then there is no doubt and everthing is clear till out residence visa becomes PR.
    but if it means residence permit or visa same as what we get for 2 years (complete 180 days every year) 1st time entering NZ then as per law child should get kiwi citizenship. Can some one enlightened on this query in detail to clear the confusion.

    Both of these visas allow you the same privilege of living permanently in New Zealand

    Thanks guys..
    So we now can conclude that resident visa also good enough to get a child NZ citizenship as per their immigration norms ACT 2009.
