    Default Very urgent.. please help.

Can someone tell me if what my immigration advisor telling is correct.

    - I'm an online marketing specialist working in an MNC in India. My company is an America based company, will my work experience be considered for points under work experience in comparable labor market (just because its an American company?).

    - My spouse studied and works in NZ. But his employment is not under skilled employment. Will his employment which is not under skilled category give me additional points if I'm the principal applicant?

My immigration advisor says so but I'm unable to believe her so want to check with you guys. Please help. Need this info very very urgently. Thanks a million

    1. I think the answer is NO. Please read the detail for reference.

    2. From my point of view, it seems like you cannot gain points. Please see:

This may be a good moment to check whether your advisor is registered.

Highly doubtful that you can gain points just because your company is US based. INZ says you should have worked in a comparable labour market country ( countries listed ) rather than worked in companies registered in listed labour markets.

i.e you will have to prove that you have worked in Co. XYZ in Malaysia for eg. to gain the points.

On the second query, do not think you can gain points for that.

Is your Spouse a resident in NZ?

If your spouse has a work visa, or residence, in NZ, and if you can prove that you are truly his partner, you should be able to apply for a partner-sponsored work visa, or partner sponsored residence. Information about these possibilities starts here, and with links off that page. http://www.immigration.govt.nz/migra...categories.htm

If you apply for residence under the skilled migrant scheme, it is your partner's QUALIFICATIONS, not the job which he may presently hold, which could get you extra points. http://www.immigration.govt.nz/opsmanual/42640.htm

About your work experience. Here http://www.immigration.govt.nz/opsmanual/30570.htm are the regulations about what is, or is not, recognized for points. Notice this paragraph, which should tell you whether or not your current work will qualify.
Work experience undertaken in a country not listed at (a) above will be assessed as being in a comparable labour market only if it was undertaken for a multinational commercial entity (including a wholly or majority owned subsidiary of such an entity that bears the same core name as the parent company) domiciled in one of the countries listed in (a) above.
I wonder, why are you using this advisor if you are so unsure about trusting her? As already mentioned above, do check that this person is licensed. http://www.immigration.govt.nz/migrant/stream/advice/ Also, be aware that you do not HAVE to use any advisor at all.

Thanks for all your replies. I thought so too that I will not get the points but the advisor is a registered one and yet tried to convince me that I will get the points. And, no my husband is not a resident.. I now understand where I stand. Thanks guys

Just a comment here... work experience for a multi-national company with HQ in America will count as being in a "comparable labour market" and therefore get you points so long as it is relevant to the skill for which you hope to get residence in NZ. Regards. Karen

Karen is a licensed immigration adviser, and KNOWS what she is talking about.

Here are the detailed regulations about work experience. http://www.immigration.govt.nz/opsmanual/30570.htm See the paragraph I quoted from there above, which confirms exactly what she just told you.
