    Default need advice please ....

    hi all,
    i need advice for my case, all input will be appreciated
    i gained my qualification in diploma in professional cookery level 5 at 30 november 2012, i get my JSV at 20 feb 2013 after that i work in a foodcourt start at februari 2013 and get my job offer and i apply for graduated work experience visa and get my 2 years work visa under company which i work for at 22 march 2013.
    my question is :
    1. i already fill my EOI and get 165 point should i submit my EOI now? some of my friends advice me to wait until one year in my currently work visa
    2. is there any minimum wages for SMC to be approve?
    3. my wife infected by hepatitis B virus (but i am not) is this will effect my residence application in the future?

    thank you any advice i will really appreciate it

    I think these answers will show you where you need to look to find out more detail of the regulations. As I don't know all the details of your situation, you should check yourself - don't just necessarily believe what I think may be true.

    You need to look at SM7.10, quoted in my next answer. If your job comes in Part C of that list, you have to have 3 years' experience.

    2. is there any minimum wages for SMC to be approve?
    If your job is classified as '351411 Cook' for your application, that comes in Part C of Appendix 6 of the INZ operational manual http://www.immigration.govt.nz/opsmanual/35165.htm. It looks as though, according to SM7.10 http://www.immigration.govt.nz/opsmanual/46411.htm, your qualification would cancel out the need for the minimum wage they mention, BUT you need three years' experience.

    3. my wife infected by hepatitis B virus (but i am not) is this will effect my residence application in the future?
    If your wife's hepatitis B is 'surface antigen positive and meeting criteria for anti-viral treatment in New Zealand', then it is going to cause at least delays, and probably, problems. http://www.immigration.govt.nz/opsmanual/45634.htm In any case, her medical is sure to be referred to the MA, and they will want reports and test results from her doctors. It is quite likely that you will be told she has to apply for a medical waiver, and the regulations say that, as your partner, if you are found to be eligible for Residence, she may be considered for that waiver as long as there is nothing else serious wrong with her. http://www.immigration.govt.nz/opsmanual/45636.htm

    my job is classified as "351311 Chef" is in part A skil level 2 is it mean i can submit my EOI now?

    You need to look here to see if you qualify. http://www.immigration.govt.nz/opsmanual/46411.htm Also, you will need to add up your points very carefully, looking at SM6 here http://www.immigration.govt.nz/opsmanual/6954.htm, which is a listing of all available points, and giving which other section to see for an explanation. The automatic point checker on the INZ website is not always accurate, so it is safer to look for yourself.

    I looked up Chef on the Essential Skills in Demand list http://www.immigration.govt.nz/templ...ACHEHINT=Guest, and this is the LTSSL requirement for it.
    Either National Certificate in Hospitality (Professional Cookery) Level 4 OR National Certificate in Hospitality (Cookery) Level 4 OR a Level 5 Diploma (specialising in the area of professional cookery) AND A minimum of five years combined experience in establishments offering a la carte/banqueting or commercial catering, with a minimum of two years at Chef de Partie (Section Leader level or higher)
    This looks as though you could not count LTSSL, and I don't know enough to understand whether one of the other headings at SM7.10 would work for you, as you haven't been working very long since you qualified, or not.

    As always, if in doubt when you have read all that, you could ask INZ.
