    EOI declined due to reasons:

    I have claimed 160 points in your Expression of Interest. I have assessed your Expression of Interest and I consider that you are entitled to 95 points under the Skilled Migrant Category.

    The minimum points requirement for acceptance into the Skilled Migrant Pool is 100 points. Unfortunately, you do not meet this threshold and your Expression of Interest will be withdrawn from the pool

    2. Qualifications in an area of absolute skills shortage
    You have claimed 10 bonus points for your qualification being in an area of absolute skills shortage as an
    ICT Project Manager.
    In order to claim bonus points for qualifications in an area of absolute skill shortage under the Skilled Migrant Category, applicants must meet the specifications listed in Column Four of the Long Term Skill Shortage List (LTSSL).
    Immigration policy states the following:
    SM16.20 Qualifications in an area of absolute skills shortage
    a. If a principal applicant does not have skilled employment in New Zealand in an area of absolute skills shortage (see SM8.20), they will be assessed as being qualified in an area of absolute skills shortage if they meet the specifications in Column 4 of the Long Term Skill Shortage List (see Appendix 4) or that was listed on the date their Expression of Interest was selected.
    b. If a principal applicant does have skilled employment in New Zealand in an area of absolute skills shortage (see SM8.20) their recognised qualification will be assessed as being in an area of absolute skills shortage if the specialist, technical or managerial expertise required for that employment was obtained through the completion of that qualification.
    c. Recognised qualifications in an area of absolute skills shortage only qualify for points if any occupational registration requirements relating to those qualifications are met (see SM19.15).

    The LTSSL states in order to claim these bonus points you must have a Bachelor degree (Level 7) specialising in Information Technology (Computer Science, Information Systems or other Information Technology)* OR Bachelor degree (Level 7) specialising in Electrical and Electronic Engineering and Technology* AND three years of relevant work experience.
    Your level 8 qualification does not meet the qualification requirement at outlined above. A Master degree (level 8) qualification does not meet the type and level of qualification required by the LTSSL.

    We are unable to take your Bachelor of Technology into consideration because this qualification is not recognised. It is not included on the List of Qualifications Exempt from Assessment and it has not been assessed by the NZQA.
    As you do not meet the qualification requirement of the LTSSL I am unable to award you the points for your qualification being in an area of absolute skills shortage.
    3. Work experience
    You have claimed 30 points for work experience.
    To be eligible for points for your work experience you must meet the following policy:
    SM11.10 Requirements for recognition
    Work experience is recognised and qualifies for points if it meets the requirements set out at (a) and (b) below:
    a. An immigration officer must be satisfied that work experience is:
    i. relevant to the principal applicant's current skilled employment in New Zealand or offer of skilled employment in New Zealand (see SM7); or
    ii. relevant to the principal applicant's recognised qualification (see SM14); or
    iii. skilled, because it required, or enabled the principal applicant to gain specialist, technical or management skills and experience relevant to an occupation that is included in the lists of occupations held at Appendix 6 or Appendix 7.
    b. Work experience must also have been gained in a labour market that is comparable to the New Zealand labour market unless:
    i. the work experience meets the requirements set out at SM13.20 for work experience in an area of absolute skills shortage; or
    ii. the principal applicant has current skilled employment in New Zealand or an offer of skilled employment in New Zealand (see SM7).
    SM11.10.1 Definition: Comparable labour market
    a. Work experience is assessed as being in a comparable labour market if it was undertaken in one of the following countries by:
    i. a citizen or permanent resident of that country; or
    ii. a person who had the lawful authority to work in that country.

    You are not eligible for work experience points because India does not share a comparable labour market to New Zealand and you do not meet the requirements set out at SM13.20 for work experience in an area of absolute skills shortage.
    4. Work experience in an area of absolute skills shortage
    You have claimed 15 bonus points for your work experience being in an area of absolute skills shortage as an ICT Project Manager.
    In order to claim bonus points for work experience in an area of absolute skill shortage under the Skilled Migrant Category, applicants must meet the specifications listed in Column Three of the Long Term Skill Shortage List (LTSSL).
    Immigration policy states the following:
    SM13.20 Work experience in an area of absolute skills shortage
    a. Recognised work experience is assessed as being in an area of absolute skills shortage if:
    i. it was undertaken in an occupation included on the Long Term Skill Shortage List (refer Appendix 4) or that was on the Long Term Skill Shortage List at the time their Expression of Interest was selected; and
    ii. it meets the specifications for that occupation; and
    iii. the principal applicant is suitably qualified by training and/or experience to undertake that work (including any specific requirements set out in column 3 of the Long Term Skill Shortage List or that were listed on the date their Expression of Interest was selected).
    b. Where the Long Term Skill Shortage List specifies that occupational registration is required for a listed occupation, principal applicants must demonstrate that they held occupational registration while undertaking the work experience, if occupational registration is required in the country in which the work occurred.

    As outlined above you do not meet the requirement of the LTSSL. As a result I am unable to award you the points for your work experience being in an area of absolute skills shortage.
    Conclusion
    This reduces your original claim of 160 points to 95 points. Therefore, your Expression of Interest will be withdrawn from the pool and will not be eligible for further selection.

    Here is the clarifications for Point 2 for aspect :Qualifications in an
    area of absolute skills shortage
    In India we cannot go to higher level of qualification Master of
    technology in electrical and electronics without completing lower level
    which is Bachelor of Technology in electrical and electronics in my
    case I have mentioned this as supporting degree for PAR evaluation
    also.

    Here is the clarifications for Point 3 for aspect :Work experience
    The current organisation and previous organisation where I utilized my
    services are IT MN C's based in India but I have worked in USA
    (2002-2009) and UK (March2012-Till Date) on intra-company transfers
    deputation to USA and UK. I can provide the proof by the immigration
    details in my passport and as well as the payslips provided during this
    period or any other proof you would recommend.

    Here is the clarification for Point 4 for aspect:Work experience in an
    area of absolute skills shortage
    In India we cannot go to higher level of qualification i.e Master of
    technology in electrical and electronics without completing lower level
    which is Bachelor of Technology in electrical and electronics in my
    case I have mentioned this as supporting degree for PAR evaluation
    And if you recommend I will go for full assessment of my qualifications
    immediately so that I can prove my claim

    Hi. I know a refusal must make you feel really based - but it all basically boils down to one thing. If you can get an IQA that states that your qualification is a match for Columns 3 and 4 of the LTSSL then everything else falls into place. Maybe you could respond to the sender of the email and say that you believe that with an IQA you will match the LTSSL and ask if there is any chance that they give you the opportunity to obtain this. If not, your pathways forward are to get an IQA that states that you match the LTSSL (ask NZQA specifically about this) or keep looking for a job in NZ (I know this is easier said than done).     You can try to get all your qualifications assessed by NZQA.

    I agree with previous posters that you need to have the non-exempt qualification assessed, and hope that INZ will allow you the time to get this done.

    There is some relevant information here. http://www.enz.org/forum/showthread....163#post463163 And PAR will not, I'm afraid, resolve anything of your situation. For this, as Karen has mentioned above, you really need the IQA. IQA can turn out a result totally different from PAR. For PAR, they only go by the names of things as provided in your information, whereas for IQA, they look at the syllabus, transcripts and mark sheets of the qualification, so they examine subjects studied, for how long, at what depth, for how many credits, with what result, and compare this with NZ qualifications to get a level.

    INZ cannot proceed with processing an EOI if the points the applicant has claimed are not in line with the regulations *. It seems to them that yours are not, for the reasons they have given. As Karen has explained above, if your qualifications are assessed by NZQA (the IQA, which looks at the actual content of the courses studied) as meeting the requirements under LTSSL, then you will have the necessary number of points. Apart from that, or a job offer, I don't think there is any other course of action that will get an EOI considered.

    * Here http://www.immigration.govt.nz/opsma...78487897550942 are the detailed regulations about applying under SMC. SM6 is a chart which lists all available points, and the last column of it shows which other regulations to look at to see all the requirements to claim those points.

    Hi all,
    I applied for my full assessment in NZQA and hope every thing comes out well.
    Regarding my work experience I have sent my deputation letters to overseas to EOI officer so she considered them and now I have 125 points so my EOI was returned to pool .And according to my assesment with full assessment I can get 150.

    My other concern in this is my Bachelor of engineering with electronics and three years work experience for which I am claiming points.
    Can I also claim bonus points for that in work experience in skill shortage (I have 8yrs of total work experience should I select below 6years removing the three years or can claim total 8yrs)

    Hi Naga,
    I'm referring some old post here. Did you get the point for "Qualifications in an area of absolute skills" and "Work experience in an area of absolute skills"?
    Actually I am in the same situation, I don't have a job in New Zealand although I am going to claim for that 15+10 points. I have 10 years of experience in absolute skill shortage and B.Tech in Computer Science. Already I have applied for NZQA for full assessment.
