    Default Permanent Residence (PR) eligibility

    Hi all,
    I would sincerely appreciate if the forum members could guide about the Permanent Residence (PR) possibilities, on the basis of a situation mentioned below:
    If someone holds NZ resident visa (obtained under SMC), he and his family stay in NZ over six months during the first year of their residency. Afterwards, he gets employment abroad and leaves NZ but manages to stay in NZ for another 45 days during the second year of residency - however, his family is free to stay for six months or more.
    Is there any possibility for him to meet the PR eligibility criteria? Please mention all possible options.

    Looking at those same regulations http://www.immigration.govt.nz/migra...quirements.htm, there's no chance of your meeting the first criterion (You have spent enough time in New Zealand) on the basis of the details you have given. However, you might be able to qualify under point 5 (Established base in New Zealand), IF you meet the requirements there - family residence, AND home ownership, or paid employment.

    However, notice that application for PR does not HAVE to happen straight away two years after activation of the visa. The two year time period is counted BACK from whenever you apply. So, for instance, if you finished your work abroad and went back to NZ to live just before your two years' travel conditions expired (so you're not outside the country at that point which would have the Residence visa lapse), you would then be fully entitled to continue living in NZ until there were two years behind you in which you HAD fulfilled the requirements, and you could then apply for PR. (But INZ prefer that migrants convert Residence to PR within five years of arrival.)
