    Default SMC Application Declined: Case closed

    Hi All,

    My application was rejected citing reasons that I do not meet the desired requirements.

    Our decision on your application

    We have declined your application for residence because you do not meet the requirements under the Skilled Migrant Category. We have made this decision for the following reasons:

    * You do not meet the selection criteria

    We wrote to you on 16 April 2013 raising concerns about your application and giving you an opportunity to comment. We have considered your response and the additional information provided on 29 April 2013. We are not satisfied that this addresses our concerns for the following reasons:

    * Your comments are noted which have been taken into consideration. You do not meet the LTSSL requirements as your bachelor degree is not specialising in Information Technology (Computer Science, Information Systems or other Information Technology) or in Electrical and Electronic Engineering and Technology. As such we are unable to allocate bonus points for your qualification and work experience. Also, your work experience from ******* and ******* was not undertaken from a comparable labour market, we are therefore unable to allocate 25 points for your work experience.

    Lessons learned:
    Relying on the fact that my qualification was in listed under exemption, hence I did not apply for IQA. My advice better to apply for IQA and be on the safer side because no CO is going to suggest you get that done to help your case.

    Hi. This is really tough for you. I am sorry. Hopefully, you will find a way round this in the future. For others, if your exact qualification and the University from which you got it after the date specified, then you can rely on the List of qualifications exempt from Assessment. If any one of these fails to match, then you need the IQA. For those who need the LTSSL "stamp of approval" for not only the bonus points but also to get round the Comparable Labour Market (CLM) issue, it is worth being very careful before assuming your qualification is a match. For these extra points and the CLM you not only need to have a qualification on the Exempt list, but it must also match the exact requirement on the LTSSL. If it doesn't, you can ask for an IQA to see if your combination of perhaps a degree in some other branch of engineering plus a Computing Diploma (for example) can be deemed "comparable" to the LTSSL qualification. Then you get the bonus points, get round the CLM issue and you could reach that magic 140 points without a job offer. I hope this helps.

    It is disheartening, I sort of experienced the feeling, when I too got a similar letter. Fortunately, I requested for a Review with additional support letters from University and some other bodies reconfirming my degree validation and later it came out positive. I hope everyone pays careful attention to this sort of application process. Good luck with your next endeavor.

    Hi Zua76,
    Can you please elaborate on the review part. Is it the appeal against the decision? I even asked my CO that I could provide supporting documents (letter from University etc.), and even could apply for IQA, but he said now he has closed my case and nothing can be done. I genuinely feel very cheated since my qualification was an exact match under the exemptions and I studied Computer Science as a Major subject. I could have provided further documents, even IQA, had my CO been specific in raising his doubts about my qualification. But his mail was misleading and having incorrect information (like mentioning that I studied four major subjects whereas I studied only three and there was no fourth subject included in the transcripts). My reply to that concern was correcting him and pointing out that I did 3 major subjects including Computer Science.

    Please guide me if I still stand a chance. And how can I apply for a review.

    Can you not appeal to Immigration and Protection Tribunal?

    Yes, CO mistakenly put me under Computer Science Degree while mine was Computing and Information System (CIS) and reduced my points, also NZQA assessed mine at Level-7 (which I understood was OK) but CO wanted specifically CIS/CS at Level-7.
    I contacted NZQA, they allowed me a Review which I then forwarded to CO. CO extended my appeal time, while I requested University for more document.
    Later NZQA accepted- so did CO. Hope this gives you some idea.

    My take is you needed IQA at earlier stage of application or some proof from NZQA about that exemption of your University.

    well that also happened with our case ..we did not go with IQA & application got rejected. We did not leave the hope & tried again. Now, we have got Residency Visa & will be in NZ in april :-)

    Hi Agaba. What was the exact date on the letter informing you that you were declined? A Review is the first stage of reconsideration against a visa decision. There are other review and appeal options, but they all have tight deadlines.

    Hi Karen!

    actually I received the decision mail in October ( too late in to write about it in forum now), but I was in a state of denial sorts. I had mailed my CO couple of times and hence lost the so called deadline for appeal. Now again when I mailed my CO for his final words, as my status on NZ website was still shown as 'Pending', he said that is wrong and that my case file has been closed with application declined. I again mailed him asking whether I've missed the appeal deadline during all this email fiasco or can I still appeal. If so what is the procedure. To reply this he wrote:

    I will write to you again in next week in relation to our final decision letter and appeal process.
