    Default SMC Visa - TimeLine to Permanent Residence (PR)

    Operational manual -RV2.5.1 Significant period of time spent in New Zealand:
    A principal applicant has demonstrated a commitment to New Zealand if they have been in New Zealand as a resident for a total of 184 days or more in each of the two 12-month portions of the 24 months immediately preceding the date the date their application for a permanent resident visa was made (ie, in each of the two 12-month portions, a period or periods that amount to 184 days or more)

    My understanding is that the date stamp in the passport of the principal applicant is the only criteria to apply for PR.

    Following is my timeline and assumptions:
    1. I (principal applicants) and the co-applicants entered NZ to activate our residence visa on 10 Nov 2013 and traveled out on 20 Nov 2013;
    2. The clock start clicking and countdown, the 2 year visa will expiry on 10 Nov 2015;
    3. To fulfill the 184 days for the first 12 months, I'll need to enter NZ by 20 May 2014 (less the 10 days already accumulated on my 1st entry) and stay till 10 Nov 2014;
    4. The next 12 months start on 11 Nov 2014 till 10 Nov 2015.
    5. My next latest date of entry to fulfill the 184 days will be on 10 May 2015.
    6. If I stay on till 10 Nov 2015. I and the co-applicants will be eligible for the Permanent Residence (PR) application.

    If I need to delay the entry by 1 month. i.e. instead of 20 May 2014, I enter NZ on 20 Jun 2014, what is the impact to our PR eligibility and the timeline for 4), 5) & 6)?

    Would appreciate any advice.

    Thanks,

    I think, in that case you fall short of around 20 days for 184 days of first year.

    Does it mean that everything get push back 20 days. i.e. We only qualify for Permanent Residence end Nov 2015?

    You have to work backwards from the date of application, and consider each of the two year periods before it individually, to see if they meet the regulations.
