    Default Applying for residence while on a WHV Visa + Skilled Job

    Hi ENZ Forum folks ,

    I have a couple of questions I havent found clear answers yet .

    I am here in New Zealand on a Working Holiday Visa and I have a job in my field (IT) wich is on Skilled Employment List .
    My job contract end on June and my visa on August.

    My question is , can I include this job on my application for residence even if I know it will ended soon; this occupation give me 50 more points .

    The last point, says , if I held this job for at least three months then I dont need to stay in the job on my arriving, am I right ?

    Resident visa conditions
    If you were granted a resident visa, you must still meet some requirements to ensure you remain a New Zealand resident.
    If you gained points for an offer of skilled employment, you must take that job up within three months of your first entry into New Zealand. You must also stay in that job for at least three months and provide us with evidence of having done so.
    If you gained points for already having a skilled job that you have held for less than three months, you must stay in the job for a minimum of three months.
    It's definitely better to include it as i can reach more than 200 points.


    Another question , if I am appoved , can I leave and live overseas during the process ?
    It brings me to the last point, how long we have to enter the country after final approval ? 12 months ?

    No. The job you hold, which is on a short contract due to end soon, won't count towards your EOI - for that, you need a job, or the offer of a job, on a permanent or at least longer term contract. http://www.immigration.govt.nz/opsmanual/30549.htm

    There's nothing inherently 'better' about a high number of points. If you've got a minimum of 140 without a job offer, or a minimum of 100 with a job offer, your EOI will be selected at the next draw. Very often, the more points someone claims, the more paperwork they have to get together to prove entitlement, and the more checking there is to be done by INZ, so the more time it will take. And there is no pecking order set up by how many points - once selected, all cases are on equal footing with one another, either on the with-job system, or the without-job system.

    Leaving aside the question of the job, if you are granted Residence while you're already in NZ on a different visa, your Residence is automatically activated immediately - there isn't any time-lag, as there could be if you were overseas. Therefore, your two years' travel conditions would also start immediately. You could travel overseas and still be able to come back during that time, but you would need to have an eye on the requirements for PR http://www.immigration.govt.nz/migra...quirements.htm or a second or subsequent resident visa http://www.immigration.govt.nz/migra...quirements.htm.

    Thank you JandM for your reply,
    I haven't seen this exception , and if I had just followed the points indicator tool I would have thought I am good with an "ongoing employment for less than 12 months" and get the 50 points.
    It would have been a problem then with immigration because this job ends soon and so I don't meet the requirements you provide .

    Anyways , currently(march 2014) without a job offer and less than 140 points it seems very risky to try an EOI .

    So I guess , my best bet is to find a job offer while I am still in NZ ( have to leave in may).

    Here http://www.immigration.govt.nz/opsmanual/6954.htm is where to find all the details of the regulations. SM6 has a chart of all the points you can claim under different headings, and the last column tells you where to look for the exact requirements.
