    Default LTBV holder applied for Residency in Feb, immigration accessing under new rules

    It is reputed from our immigration advisors that immigration is attempting to use the new rules on our Residency application, even though we came on the old plan. It is in the online manual that any in stream LTBV holders will be assessed on the policy when they applied. what is going on? I need some serious help

    In principle it is should not affect LTBV holder applying Entrepreneur visa as there is no change in the Entrepreneur Visa category (now known as Entrepreneur Residence Visa), however, in practice, who knows they may be swayed by the current Entrepreneur Work Visa instructions.

    This http://www.immigration.govt.nz/NR/rd...igrationQA.pdf is a definite statement from INZ that the existing rules will apply to people in your situation. See the bottom of page 2, and on to page 3, here. Your advisers and you need to fight your corner, and ask to be referred to a supervisor if the official dealing with you persists in trying to do the wrong thing.

    It sounds as though you need to ask THEM that question, hard and often!
