Default Applying work permit for the second time

    Hi guyz,

I am still waiting for my SMC result. Applied 23 oct 2013. INZ did interview 3 weeks ago. Work visa (WD1) expiring in 10 dec 2014. Should i apply for my visa renewal. Also what other documents do I need for that. Somebody told me that I might need a proof that my boss has advertised the job. Is it true. Please help.

A scenario we often see is that the applicant will write to INZ when their existing visa has about eight weeks to run, pointing out that it is coming to an end, and asking if it's likely their Residence will come through in time, or do they need to apply for a work visa to cover the gap? Very frequently, the Residence magically appears within the next couple of weeks. But even if it doesn't, there is still time at that stage to get a work visa, and keep legal. So it doesn't look as though you need to do anything YET.

Exactly what sort of work visa do you have at the moment? Not all work visas need the job to have been advertised, so though the person may have been telling the truth for some case he knew about, it may not be the case for you at all.

What studies did you do in NZ? And what job have you gone into? This can make a difference to the application you can make next, as, if the job is on the Immediate Skill Shortage List http://skillshortages.immigration.govt.nz/, you will not have to show proof of advertising by your employer.

Here's the mention of the Essential Skills work visa. http://www.immigration.govt.nz/migra.../requirements/

If you have a job offer from a New Zealand employer and do not fall under one of the categories for specialist workers below, you may apply under the Essential Skills work category. The employer will need to show that no New Zealand citizens or residents are available to do the job, either by:

showing that the job is included in one of the Essential Skills In Demand Lists; or
providing evidence that they have genuinely tried to find a New Zealand worker to fill the position.

In addition, you must be appropriately qualified by training or experience to take up the position. See the full list of requirements.
