    Default Partnership Based Work Visa

    Hello everyone,

    Quick question - If you sponsor your partner to join you in NZ on a partnership based work visa initially and then the relationship breaks down before the partner gets residence, do you then have to wait 5 years before you can sponsor again? Or is this only if the partner successfully obtains residency?

    Quoting from the INZ manual http://www.immigration.govt.nz/opsmanual/index.htm

    " F2.10.10 Definition of ‘eligible to support a residence class visa application under the Partnership Category’

    a.For a New Zealand partner (F2.10.2) to be eligible to support a residence class visa application under the Partnership Category they:

    i.must not have acted as a partner in more than one previous successful residence class visa application; and

    ii.must not have acted as a partner in a successful application for a residence class visa in the five years immediately preceding the date the current application is made;

    So, for residence purposes at least, this relates to "successful applications"

    Hi ChrisMwn,

    This is exactly why I have asked this question because their manual says "successful residence applications" and doesn't say anything about "successful work visa applications" which partners are generally approved for when they haven't lived together for at least 12 months and only for a few. I'll give them a call and ask them.

    yes, quite right. Immigration Instructions are silent on work visa applications. There are just the declarations made in the Temporary entry partnership support form, so it seems you can sponsor other for temporary entry within 5 years, (even if there had been successful residence application.
