    Default please advise on applying for work and or residency visa with a job found on a whv

    We have my husband on a working holiday visa one year from the USA. He has a permanent job offer. Called the Wellington office and they said they don't care if the company calls it permanent or temp... as long as we don't stay temporary.... So she said we just need to quit the job when the one year visa is up....

    Company is happy to help us put in for a longer work visa.

    We want to go ahead with residency... So will submit our eoi...

    is there a problem if we submit his long term work visa or a residency application with job A being listed as an offer for permanent employment if we are holding the same job on the holiday visa?

    I mean do we need to apply for a longer work visa.....
    Get that

    Then apply for the residency visa

    Immigration lady said something about makeing sure they have tried to find other workers and put offers out for others...the company has done this, but will they need to do it again if we put the same job on a second application?

    the WHV doesn't allow "permanent employment". However since you only have a visa for 12 months, it cant be permanent! Get your EOI lodged, and then residence application when ITA comes, with job offer confirming employment will be permanent, subject to the grant of PR. Don't get too worried about using the job you got while on the WHV, for your PR application.

    So going to do the eoi... skipping the long-term work visa should be okay?

    the following announced today will be most useful to you:

    WK2.20 Instructions on duration of Essential Skills work visas
    A 12-month Essential Skills work visa can be granted without a labour market test being completed if the applicant has been Invited to Apply for residence or is awaiting a decision on a Skilled Migrant Category application
