    Default Residency Permit

    Hi Everyone,

    I am a Kiwi currently living in the UK, I got married 7 years ago to a lady who was born in India to British Parents in 1949, she was only in India for 3 months before the Family came back to the UK. We are now planning to move to NZ & we are preparing details for her Residency Permit, it says that they require a police record from ALL countries she has lived in, would she need to include India as it was so long ago? If so does anyone know how one would go about this?

    Also, we intend to apply when we get to NZ, if the Residency application is not completed before her 6 month visitors visa expires what happens? How long does it normally take?

    Finally, what should we take from the UK in terms of references for the Residency Permit Application?

    You must provide police certificates for everyone 17 years of age or over included in your application, from:

    each person’s country of citizenship, and
    each country that they have lived in for 12 months or more in the last 10 years.

    I wonder if you've realized that, as you've been overseas for five years and more, and you've been married for five years and more, if she applies for partner-sponsored Residence before travelling to NZ or within three months of arrival, she would be eligible to be granted Permanent Residence directly (instead of getting Residence, and then having to qualify for Permanent Residence after two years). Also, a PR holder doesn't have to activate their visa within a set amount of time (which can help travel plans be more flexible). http://www.immigration.govt.nz/opsmanual/46503.htm F1.5.1.

    I wonder if you may get an odd reaction from INZ at the airport upon arrival if your wife goes in as a visitor. The normal official thinking is that a visitor, by definition, is in the country temporarily, and will leave and go 'home' again. It will be obvious that your wife isn't in that situation, as she's travelling with you - there could be delays, and interviews about her intentions, and if she's being frank with them. It could be worth investigating the partner sponsored visitor visa, if you're definitely not going to put in for her Residence before travelling.

    If she gets within about 8 weeks of the expiry of whatever visa she enters the country on, without any word from INZ, it would be worth contacting the CO (if one is appointed yet), to ask if it's likely to come through in time. Otherwise, she might have to apply for a partner-sponsored temporary work visa, in order to stay legally in NZ. Partner-sponsored Residence has a much higher priority for those outside NZ than in. INZ like their Kiwis to come home, and their foreign partners are hurried through as the price for that. You can see INZ's estimates of time by Googling "INZ (whatever) branch processing times", both for wherever you are likely to submit in NZ, and for London.

Keep collecting evidence even after the application has gone in, because it's normal for the CO to ask for more evidence to cover the time while it has been being processed, so that they don't issue a visa to someone whose relationship has broken down in the meantime.
