    Red face Help!!! Visitor Visa On partner based need advice

    Hello everyone ,
    I been living in NZ for 3 years and my partner is nz citizen. Our relation is more than 1 year old and we got the proofs to show it. We have never lived together since we both were student and couldn't afford paying rent and bills so she is living with her parents. My visa was running out and I have applied for partnership based visitor visa without knowing that 'Living together' was one of the requirement of this visitor visa category. INZ decline the visa saying we do not meet 'living together' requirement. Now i am unlawful in nz but i am going back and i will apply for general visitor visa and i have mention my partner in it since she is sponsoring me with funds. in cover letter i have mentioned that the purpose of my visit to nz is to join my partner and to meet the'living together' requirement i have to be in nz so i can apply for further work visa and have future with my partner. Please review the evidences i provided below:

    1. completed INZ117 and INZ1025(attested) and certified copy of her nz birth certificate.
    2. My partner's 3 months old transactions and current bank statement of nzd 4600.4 months visa and extra for onward ticket.
    3. Letters from her parents and our mutual friends about our relation.
    4. Our holidays tickets and accommodation bookings.
    5. Letters from us two stating our relationship story and support.
    6. Our NZ joint bank account statements.
    7. About 70 photos including family function.
    8. Skype and phone records when we were apart within NZ.
    9. Cover letter from me saying i want to join my partner and want to live in nz. to meet the requirement of living together i am visiting nz.

    As last time they were able to satisfy with the genuineness of relation but not with living together. So i want to know if there is anything wrong i am stating in cover letter? i am being honest with my purpose to nz and i never had criminal record or any trouble with law. my medicals and pcc is upto date. Please comment and let me know asap. thanks

    What exactly are you asking?
    Looks like you have all the documentation you need. It's just a matter of waiting now.

    Hello everyone, i have got partner based visitor visa declined saying i don't have tie ups in India that would encourage me to return back. Now i am planning to apply for student visa and i have talked to consultants here and they said that INZ will consider me as not a bona fide entrant as they knows my visitor visa was declined and i have partner in nz. I want to know what more evidences i can give to convince them that i am a genuine student and will return after finish my study. Or i tell them that my intentions are to meet my partner and student visa is the only way. I have got everything ready and supporting letter from college as well. Please give me some suggestions.

    Really sorry to hear on your situation.

    You shouldn't have applied for a partnership visa without being aware of the requirements of the visa.

    The second time, you should have consulted a Licensed immigration advisor for advise.

    I am afraid that you won't be considered for a student visa as you will not be a bonafide student and you have told INZ your intentions in previous application and considering the time lapse is insignificant, the circumstances remain the same.

    INZ is very strict on living together requirements as to assess the relationship us valid and true , nothing else. Factual evidence stands up.

    From your post, I believe you are from India, It's good you shall be in touch with a Licensed immigration advisor Onshore or offshore.

    I don't think there is anything extra you can do to convince INZ, if they are inclined to distrust your motives. With support from the college, they should see that you truly have gone through all the procedure to apply and qualify for the course. But your recent past history of applications under partnership, for which you didn't qualify, is likely to be against you.

    Have you asked for a limited visa? my partner was not considered bonafide as she stated she would like to have a visitor visa to live with me so we could get a partnership visa, they declined that visa and offered a limited visa as an alternative, we took that and now have the chance to live together to have the required evidence for a partnership visa. although she has to return home again and apply for the partnership visa offshore this was our only option to be together. One thing that is concerning though is that I think we will only get one chance at the partnership visa, as if she goes back and applies and is unsuccessful it will be declined, and im not sure if they will offer a visitor visa as an alternative as she was considered not bonafide for the first visitor visa she applied for, they said she did not have significant ties to her home country also

    did applied for student visa and unfortunately its got declined the reason was as follow:

    "Our assessment of your application is as follows:
    You were interviewed to gauge your genuine intent to study in New Zealand.
    During the interview you were unable to provide satisfactory responses to questions that were asked around your rationale of choosing the course and specialisation, benefits of the course, questions around the chosen specialisation, future prospects of the course and job opportunities available to you after completion of the course.

    The assessment also indicates that you may not have persuasive personal, occupational and financial incentives in India to return to, in the event you are unable to complete the proposed course from New Zealand.

    Considering all of the above, we are not satisfied that you are likely to meet the student visa instructions U3.1.b.ii and E5.1. The immigration instructions have been attached for your reference in Appendix A.
    We have considered whether the granting of a limited visa would mitigate our concerns but we do not think that it would. We have also considered whether there are any special circumstances which would warrant an exception to immigration instructions but we can find no reason to grant a visa as an exception.'''


    I and my girlfriend are planning our wedding soon. The wedding will be legit with both's families involved. We will get legal marriage certificate as well. As i had two declined visitor visas(the reason was we were not living together) before and i had to return back to India and one student visa declined recently. I was wondering if INZ they will consider the marriage genuine not the on purpose one. Please advice me. And should i go for nz lawyer or the one from my country(India)

    In your situation, I think you need to use a lawyer or Licensed Immigration Adviser. You want to be told what to do, and ordinary people, like most of us on the forum, are not allowed, by NZ law, to advise. That's right - we CAN'T advise, we can only share experiences, or point out where there is publicly available information that may be useful.
