Default Convertion from Dependent applicant to main applicant

    Hi,

My sister came to New Zealand on student visa in 2014, and she has completed her studies in 2015. Now she is in open work visa and at the same my brother-in-law came as dependent in last year. at present he is also having temp work visa and working for GMP dairy.

Is there any chance that my brother-in-law can become a main applicant if his company suppports a work visa. becuase my sister couldn't find a job which support work visa for next two years. at present they have few months left to get the job.

    Could you please suggest us.

    Thanks

Yes. If he gets the offer of a skilled job, or one they couldn't get a NZ citizen or resident to do, things can go two ways. Either he could apply for Residence under SMC, if he qualifies straight away, in which case your sister would be on the same application. Or else he could go for a temporary work visa, whichever best fits the situation http://www.immigration.govt.nz/migra.../requirements/ or http://www.immigration.govt.nz/migra...ce/default.htm, and your sister could at the same time apply for a partner-sponsored temporary work visa. http://www.immigration.govt.nz/migra...milystream.htm
