    Default Second or Subsequent resident Visa

    Dear Group Members,

    Good day,

    I have some questions on the Second or Subsequent resident Visa.

    Currently I'm outside of New Zealand and most probably my resident visa travel condition would expire. I was trying to establish a business in New Zealand to show my commitment as per immigration clause. RV2.5.15 Establishment of a business in New Zealand.

    My business haven't been started though recently i got the council approval and lease has been signed.

    Points that need clarification:

    - After my travel condition expires i have to apply within next 24 months for a Second or Subsequent resident Visa.
    - Do Second or Subsequent resident Visa lead us to PRV.
    - Once we have Second or Subsequent resident Visa is it mandatory to travel to NZ to remove the travel condition like we did this for RV.
    - If the travel condition is must, does my family need to travel along with me to NZ.
    - how long is the validity of Second or Subsequent resident Visa.
    - Can i apply for PRV immediately once i get the Second or Subsequent resident Visa. or i have to wait for certain time period. What is the certain time period

    Any other useful information that can keep my resident visa valid.

    You can only rely on the 'within twelve months' permission IF, when your travel conditions expired, you would have already been eligible for PR. See under the Evidence column, for the Visa Eligibility column here. https://www.immigration.govt.nz/new-...AU&applying=co That is, you would have to been able to show you had met the conditions for PR, including the 'commitment to NZ' part.
    Do Second or Subsequent resident Visa lead us to PRV.
    The Second or Subsequent resident Visa puts you in just the same position as the original Residence visa did. You have the right to come and go freely to NZ for the length of that visa (and the length will depend on your commitment to NZ before that - see the INZ page https://www.immigration.govt.nz/new-...-resident-visa). Likewise if you apply for the Variation of Travel Conditions.

    WHENEVER you apply for PR, INZ will look at the two 12-month periods immediately before your application, and it is that period of time in which you have to have met the conditions. They count BACKWARDS. So the second or subsequent residence visa is just giving you a further period of time in which you can fulfil the conditions.

    I don't THINK you have to go to NZ to activate the visa you would be given (note: the travel conditions are activated, not removed - travel conditions are permission to re-enter NZ without hindrance). I believe they start running from the time the new visa is put in your passport. Contact INZ to check this.

    Your family who were on the original Residence application with you will get whatever further visa you do - second and subsequent, or variation of travel conditions. You, the main applicant, qualify for whatever it is on behalf of all of them.

    How long you will get depends on what you have done before - see above.

    Can i apply for PRV immediately once i get the Second or Subsequent resident Visa
    You can only apply for PR when you meet the conditions, looking at the previous 24 months (see above).

    Post Second or Subsequent Resident Visa

    Hello all,

    I have some confusion over eligibility for Second or Subsequent Resident Visa.

    I got resident visa in April 2014. I left NZ in February 2015. I never returned to NZ after that. Now I'm planning to go to NZ again. I know my resident visa is expired now ( as of August 2018).

    Am I still eligible for Second or Subsequent Resident Visa as I'm applying after more than 4 years after I got resident visa?

    No, you're not. You will have to start all over again, putting in an EOI for residence under SMC. And you need to be aware that the regulations have changed quite a lot since you last applied.
