    Default Essential Skills Work Visa

    Hi,

    This is Chrissie. My friend recommended the forum to me and I've been reading the useful posts for a while. Thanks for the sharing.

    Right now I'm kinda in a dilemma. A brief introduction about my background: I came to NZ in Mar, 2016 with my husband, both of us got WHV for a year. And I found a full-time job titled-Digital Marketing Coordinator in Oct, 2016. So I started to apply for Skilled Migrant Resident Visa last November. My EOI points are 160 and I received ITA on Nov.16, 2016. However, since My WHV will be expired in Mar, 2017 and my employer says I should probably start to apply for a work visa.

    My problem is, I talked to HR and her feedback about applying Essential Skills work visa

    1. The company needs to advertise again and provide employer’s evidence to the immigration
    (I checked on Immigration's website and it says the evidence is not necessary if "You are applying to continue working in the role you currently hold and have been invited to apply, or have applied, for a Skilled Migrant Category Resident Visa based on your current employment." In that case, is a job advertisement really necessary?)

    2. On my SMR visa, I used code 225113 MARKETING SPECIALIST(ANZSCO Skill Level 1) because my job title is Digital Marketing Coordinator and I'm sure it fall into the Alternative Title-Marketing. However, HR said my job title doesn't fall into ANZSCO Skill Level 1 since the level 1 is for senior positions.

    What's your suggestions regrading my situation? Am I put the category wrong?

    Your "HR" appears to be providing Immigration Advice. That's unlawful

    Hey Sebastian,

    Thanks so much for your message. That's really helpful. Well on my employment offer the title clearly writes "Digital Marketing Coordinator", that's why when I applied for SMR visa I put the code under Marketing Specialist. And when I showed HR what it says on the immigration website, she said she doesn't feel comfortable without providing employer's evidence to the immigration because the past cases that she had dealt with were all the same procedure.

    I'm just saying it could be a waste of both time and money going through the whole process. I guess I have to talk to her again when she is free. Anyway, Thank tons!

    Hi Chrissie, I actually have a question for you... you're currently working this permanent FT job while on your WHV?

    As ChrisMwn said, the HR person should not be telling you what to do about the details of your application(s) to INZ.

    1. About your employer not needing to provide the labour market check when you already have ITA quoting the same job, see WK2.5.15 here. http://onlineservices.immigration.go...nual/45676.htm

    2. It is the ANZSCO classification that decides if a job is Level 1 or some other Level. Here are their definitions. http://www.abs.gov.au/ausstats/abs@....1?opendocument In some workplaces, ALL the employees' jobs would have to be at Level 1, because they need graduates to do the work involved. That isn't the same as the order of seniority within the company. A business might grade their employees at different "levels" according to who or what they control, but that isn't the same as ANZSCO Levels.

    Yes. One friend of mine did the same thing while he applied SMR visa. He came here with WHV and got a FT offer. When I started the job, I actually talked with HR and I was told it could be okay to get the Essential Skills Visa later as long as before my current one expires.

    Thanks so much for the info. I really appreciate it!

    Speaking of the skill level, I had a master in Advertising from the U.S. and I did have over 2 years of digital advertising experience back in China. That's why I feel like this position is a perfect fit for me and it was right there on the JD that I met all the qualifications. Therefore I applied to SMR visa once I got the offer and hopefully I'm on the right track.

    Really glad to hear that. I have the WHV and received a permanent FT job offer and decided to stay in NZ. I am going for the SMR but was worried my permanent role on the WHV might cause an issue. Suuuuper happy to hear you know of similar situations that met success.

    No worries. So far I just mail my documents to the immigration and I haven't heard anything back from them. They suppose to deduct the fee and sent me an email but I guess it may take longer than I thought. I will keep you updated on my process.
