    Default Essential Skills Work Visa Changes-Question

    Hi all,

    I am asking this on behalf of a friend who's not registered on this forum yet. As per the recent changes in the essential skills work visa, is a person with a salary greater than $49,000 and ANZSCO Skill Level 1 job eligible to apply for an ESV right after his current visa expires? Or will the "cool off" period apply to everyone?

    As far as I understand cool off period—gap between two consecutive ESVs applies only to low skilled jobs with salaries less than $49,000.

    Please let me know if my understanding is correct.

    I think the proposed changes under ESV which is supposed to take effect in August 2017 will only apply to those new applicants but if your friend's visa is expiring and puts in an application on the date after the new rules take effect then his application will be assessed under the new instructions.

    Thanks for the links, these are quite helpful. His visa is expiring on the 2nd of September this year. So, he will automatically be put under the new rules, I think.

    Yes I presume. You have to watch out for the upcoming changes when they become official on INZ website. I believe nothing becomes official unless posted in INZ website other than from media announcements.
