    Hello everyone,

    Appreciate any inputs on the query below:

    Partner will be graduating in the month of August for a level 8 course. However, while submitting the SMC EOI, unable to claim points for the same owing to the pending status of graduation.

    Will it be possible to claim 20 additional points if the EOI in both situations: accepted or declined.

    Also, if declined, would it be possible to resubmit the same EOI or it will need to be resubmitted as a new EOI under and also under old rules / new rules wef August 2017.

    Also, is it possible to claim extra points for partner's qualification during the ITA phase or it's not necessary at all?

    I'm back to answer you, as I would have been without the bump! Please note, this site doesn't have staff. The mod team are members of the public, keeping an eye on the forum in our spare time. There isn't a constant presence.

    Your EOI, submitted last week with 180, should be being selected today, by machine, on the basis of the number of points claimed. You will be notified once clerks have had a chance to look it over, to see, just on the basis of what you have said (with no deeper checking) that your points APPEAR TO BE justified, and in due course, you will get your ITA. If that goes through as expected, you don't need any extra points, and there is no reason to add them, because it would mean another thing to be checked, therefore adding to your processing time.

    If the rules were continuing as they are, after you put in your ITA, some of your points were found not to be justified and this took you below 160 but above 100, you would have gone back in the pool, and would have had a chance to add your wife's points to get re-selected if they would take you back above 160.

    But the NEXT fortnightly selection will be the last under the old rules with this present pool, so this option would not be available to you. You would have to start a new EOI under the new rules.
