    Question Australia Permanent Resident Visa

    Hi

    I have been reading the gov website, this forum and anything else google finds and I am still confused.

    Can someone confirm for me please.

    Background. I have an Australia 189 visa (activated).
    I am now looking to move to NZ.

    I understand that on arrival I can apply for an “Australian resident visa” based on my Aus189 visa.

    Questions I have are:
    1. If I stay at in NZ for two years do I automatically (on application) qualify for a NZ PR visa?
    2. If yes - does the NZ PR visa have travel restrictions?
    The Aus 189 PR visa has a 5 year travel restriction
    3. If the Aus 189 PR visa travel restriction kicks in can I still come to NZ and use this to apply for a NZ “Australian Residents Visa”?

    If that visa makes you an Australian permanent resident, then yes. https://www.immigration.govt.nz/new-...-resident-visa Notice that, if you are aiming for NZ PR, you need to apply for Variation of Conditions (VOC) once you get the Australian Resident Visa from INZ, otherwise any time you leave the country and re-enter, you would have a NEW resident visa, not time accumulating on the original one, and...

Incidentally, as it isn't spelt out on that page, notice that applicants for PR have to meet the character requirements for Residence. (Several forum members have fallen foul of this after brushes with the law during their first two years Residence in NZ, e.g. DUI, or more than one traffic offence so that they were automatically a court case, not an infringement dealt with at the roadside, as some traffic offences carry a maximum penalty which takes them over the threshold for liability to be deported.)

    No. When a person holds NZ PR, they can come and go freely for life.

    Looking here https://www.immigration.govt.nz/new-...-visa#criteria, in the Evidence for Australian Immigration Status section, I find this.
    Otherwise you can use a foreign passport that confirms you’re both an Australian permanent resident, and hold either:

    a valid Australian Permanent Resident Visa
    a valid Australian Resident Return Visa.
    So it seems that you need, at the time you arrive in NZ to claim your NZ Australian Residence, to have the Australian 189 visa with its five-year travel permission still current, or Australian RRV. It is the time of arrival that needs a currently valid Australian visa - it doesn't matter if you go in on the 189, and it lapses after you are in NZ, as long as by then you have the NZ Australian Resident Visa with VOC.
