    Default Non-residents parents, child born in NZ

    Hi all,

    Both my partner and I are currently holding work visa and we are not qualified to apply residency visa yet.

    Our child is due in Mid-August this year.

    What should we do when the child is here? Obviously the child will not have passport from our home country, and the baby is not qualified for NZ passport.

    Anyone have similar situation who can shine some light on the matter?

    My nationality: Hong Kong
    Her nationality: Taiwan

    This page https://www.quora.com/Do-babies-born...ceive-an-HK-ID has an answer which seems to show that, since you do not yet have NZ residence, you may still be able to pass Chinese nationality on to your child. There is more information here. https://en.wikipedia.org/wiki/Nationality_law_of_Taiwan Obviously, neither of those websites is official - to get a definite ruling about what nationality your baby can be given, you may need to contact the Hong Kong/Taiwan/Chinese authorities.

    It is also possible for a child to become a NZ citizen if they would otherwise be stateless.

    You need to apply for HK or Taiwan passport for your child then apply for dependent child visa.

    Thanks JandM and larrykiwi for your advice!

    I checked with Hong Kong Immigration and confirmed my child should be able to apply HK passport

    I tried to call INZ to find out more information, was told just as JandM suggested that my child will be deemed to hold a visa. The duration of visa will be as same as parent.

    However we are facing a tricky situation here, as our visa expires in Oct 2018 but child is due Mid-August. Once the child is born, she will only have roughly 2 months to get a passport from our country. If we failed to do so, then she will fall into Section 51. INZ told me the baby couldn't leave the country because she doesn't have a passport, so probably the only way is to request an emergency passport from our home country.

    We told immigration straight away. They just wanted a copy of my son's birth certificate then once we got our UK passport for him, they issued him a visitor visa for as long as our work visas are for. Our UK passport came within 3 weeks so not too long of a wait.
