    Red face Confused with instant application lodging and partner points

    Hi All,

    I am writing here on behalf of my friend. He is really confused about lodging his skilled migrant resident visa application and claiming points.

    He's currently working at New World as a Buyer and and earning $19.50 at the moment.
    Fortunately his employer agreed and now giving him the new contract(Manager) with salary above remuneration threshold.
    Can he submit his EOI and lodge residency application straight after getting his new contract and salary? or he needs to wait for few more months working as a Manager?
    Can his CO thinks about his instant salary hike?(from $19.50 to $25)


    He's also thinking to include his partner in the application to reach 160 points as he only scored 150 points with new point system.
    She is working as a Senior Technical Support Advisor and getting $23/hr.
    Can he claim 20 point for his partner as she is working in skilled employment ?

    I would really appreciate any help

    He doesn't need to wait before applying. (A person can apply even when they only have a job OFFER, not even having started to work yet.) What he was doing BEFORE the skilled job is nothing to do with the matter, and won't have any influence on the working of the case.

    Here https://www.immigration.govt.nz/opsmanual/#66811.htm is the section of the rules which has all the requirements for claiming points for a partner's skilled job and/or qualifications. (Notice, the couple must be able to show that they have been partners living together for at least 12 months before the application, as well as the requirements of the job.)

    We were expecting it Thanks.
    They are already living together from 24 months and had sufficient evidences.

    Everything seems perfect but we are really not sure about "minimum remuneration" of partner after reading SM6.10 Skilled Employment
    Do INZ need $24.29/hr for partners as well?

    Like he already got the Manager contract and earning above minimum remuneration but only had 150 Points and her job is skilled but she can't get above $23/hr !! Really a MESS !!

    Looking at SM6.10, yes, the salary level is now part of the assessment of whether or not a job is skilled or not.

    As the partner is in a skilled job (by all normal definitions, though INZ has thrown in the salary level as well making it more difficult), does she perhaps have a recognized qualification that would get the extra points they need? https://www.immigration.govt.nz/opsmanual/#66838.htm

    Yes, she has a recognised qualification of Level 5-6, thus we cannot claim the extra points for it. Both have the same qualifications.

    What I just noticed here is, They both are in the same situation.
    If we think from her side - then she is also getting 150 Points.

    Age - 30 Points
    Skilled Employment - 50 Points
    Outside Auckland - 30 Points
    Qualification - 40 Points

    They cannot apply at the moment as both are getting 150 Points - They can only apply if they both can get above minimum remuneration? and would get the extra 10 points?

    That seems to be correct for this particular couple, from what you have said. Of course, if either of them could get the extra 10 points in some other way, that would also do the trick. Have they looked at the whole set of regulations for SMC? https://www.immigration.govt.nz/opsmanual/#6954.htm SM1.10 has a chart showing all possible headings for claiming points, and the section to look at for the exact requirements for each.
