    Default lodging ITA while on interim work visa

    We are getting conflicting information from inz customer service, therefore we decided to ask this question here. My partner is on interim work visa and is waiting to receive her partnership work visa since 2 months now. We lodged EOI and got ITA next day. Our IELTS scores expiring in June and therefore we wanted to lodge our ITAs asap. She being the principal applicant for SMC application and is on interim work visa. Can we lodge our ITA? She is legally working and I think smc is based on the job offer. Please help

    she basically can lodge ITA anytime, as it doesn't relate with any temporary visa application.

    My ITA lodgement failed while I was under an interim visa last year.

    What reason they quoted for your failed lodgement?

    The INZ Operation Manual does not mention anything like that which may affect the ability to lodge the ITA. As per the manual (https://www.immigration.govt.nz/opsmanual/#66770.htm):

    SM3.1 Ability to apply

    A person may only apply for a resident visa under the Skilled Migrant Category if:

    a. they have been invited to apply under the Skilled Migrant Category; and
    b. they apply for a resident visa under the Skilled Migrant Category within four months of the date of advice from Immigration New Zealand (INZ) of that invitation; and
    c. that invitation has not been revoked.

    It occurs to me that it may make a difference what visa the person was on, before they applied for the temporary visa which is still being considered while they have been granted the interim visa.

    EGoodhue, can you help here, please?
