    Default Resident to Permanent resident for Partner

    Hi,

    I got my residence and will be qualified to get permanent residence by next October. now I have applied for residence to my spouse and kids in partnership based residence visa category, if they get the residence by next month, can they also apply along with me for permanent residence by next October.

    Please let me know.

    As per RV1.20, it depends on who the principal applicant is for each residence application.

    From what I've seen on these boards with respect to the Partner of a New Zealander Resident Visa, your spouse is likely the principal applicant on that application, with the children as non-principal applicants. If this is indeed the case, you and your spouse will need to qualify (and apply for) for a Permanent Resident Visa individually and separately, but your children (being non-principal applicants on your spouse's original residence application) must be included in your spouse's application for a Permanent Resident Visa unless RV1.20.5 applies to them.
