    Default Fixed term job and SMC

    Hey all

    I'm submitting my application for SMC and have a small question about my fixed term job.

    My current manager offers me a extended offer for another 12 months (I've been working in this position around 8 months now.) The new offer letter is titled 'fixed term employment variation ' and it's from 31 Jul 2019 to 24 Jul 2020.

    from my understanding I can apply for SMC if I hold a job offer no less than 12 months and the position is on-going etc... But my question is: since it's a variation offer, my offer should be over 12 months. Will the immigration reject my application just because my new offer is from 31 Jul 2019 to 24 Jul 2020 and not technically a full 12 month?

    I would also consider the time it takes for EOI submission, selection, ITA, ITA doc submission and the big one, CO allocation as well. Then should be able to prove that your contract is still on-going when that happens..

    If contract is still on-going when that extension happened i think its acceptable for the immigration for you to extend.

    My employer should have no problem answering those problems. Just a bit confused about 'Where an offer of employment or current employment is for a stated term of at least 12 months, ...' (from the link above). in my case I'm still in my current employment/position. Will my fixed term variation letter be consider as a new “offer”? If so 'an offer of employment is for a stated term of at least 12 months' will not be applicable?

    I'm nothing official, so I can't give you a definite yes or no, but just going by the likely intention of the rules, I think that in common sense, INZ should be able to see that you've already had a term of the same employment, and this fresh contract will add on to it to make more than 12 months. That's where your employer's willingness to support you and explain what his intentions are will be helpful.
