    Default Partnership Visiting Visa Declined

    Hey

    I had applied for PVV on april 1st , partner is NZ resident and we are newly married -got married in Jan and had spend 24 days together . We had submitted all updated evidences including chat, call history, bank statements, funds etc still my visa was rejected on the grounds that
    "The time that you have
    spent apart outweighs the time that you have lived together. We have noted the few documentary
    evidence with common address (bank document with common address); however this, in isolation
    cannot demonstrate that you both have lived and established a life together as a couple considering
    the duration of living apart."


    But my CO didnt even bother to send me email requesting further evidences or didnt even made a call.
    I am really depressed and pissed off.

    Is there any way that i can ask them to reconsider /appeal?
    or should i reapply?

    my husband had taken 6 weeks leave for marriage ,more than that employer couldnt grant leave . We had explained all this in cover letter , still they declined

    Partner-sponsored visas are judged by INZ on evidence of having lived together, so without that element there is always a problem, even though a couple have married. Because there is awareness of the cultural differences involved, they have recently issued this directive. https://www.immigration.govt.nz/docu...lationship.pdf As you see, you need to apply for a partner-sponsored visitor's visa, but supply a cover letter explaining your situation, with all the background details which can be considered by their Partnership team, and asking if you can ALSO be considered for a General Visitor's Visa if they can't consider you for partnership. My guess is that your application missed out on this option because it was already in the system when the directive was issued. The INZ complaints page specifically says you can't use it to dispute a decision they have made, so if you tried saying that you should have been given this possibility, they might simply refuse on the grounds that the directive can't be applied retrospectively. But you might want to try. If it doesn't work out, you can apply again.

    Or else can someone apply for GVV directly rather than going for PVV ?

    In that link, it specifically says this.
    If the intention to be in NZ is due to the relationship, applicants should apply for a partnership visa and, if it is established that partnership requirements are not met, a GVV can be considered.

    This is the response I received from INZ :


    "For any partnership based visa, you must be able to show evidence that you and your partner are living together in a genuine and stable relationship. If you will only have a short period to live together after getting married, it will be very difficult to show evidence of living together. So, it is recommended that you show as much evidence of your partnership as possible, and if the Immigration Officer is satisfied that the relationship is genuine and stable, he/she may grant a partnership based visitor visa to allow your partner to join you in New Zealand and start living together."

    After viewing the post from "Shadowcat", I doubt how I can get the PVV based on the number of days stayed together?

    thanks JandM , i tried emailing them asking to atleast grant us GVV based on the TEMPORARY VISA APPLICATIONS FOR APPLICANTS IN A
    RELATIONSHIp document but they refused .

    it depends according to the specific CO, we got decision within 1 week .. did not get any interview call , didnt ask for further evidence
