    Default Resident Visa Holder - Travel Condition extension or PR?

    Hi all,

    Hope someone know the answer to my visa concern.

    I gained NZ Resident Visa on 26th August 2017. I spent over 184 days in NZ as a resident the first 12 months (to be exactly 358 days).
    Then family issues kept me away from NZ for 11 months.
    I returned to NZ just few days before my travel conditions expired on the 26 August 2019.
    So I did not spend the 184 days on the second year as a resident. (only spent 32 days in NZ in my second year of resident visa)

    My questions is:

    Should I just wait another 184 days to apply for PR? or should I apply for an extension of travel conditions?

    You need to know that INZ count BACKWARDS from the date of application to check the criteria for either PR, or further travel conditions. So, from what you say, it sounds as though you would at present qualify for a variation of travel conditions, having spent at least 184 days in the country in one of the two-year periods before you apply. https://www.immigration.govt.nz/new-...vel-conditions (But the longer you wait, more of the first year you had your residence and were in the country will slip beyond the two years they will be looking at, and cease to count.)

    If you decide to wait to apply for PR till you are eligible on the criterion of time spent in NZ, you will be looking for a time when, in the 12 months immediately before the application goes in, you were in NZ for at least 184 days, and you were ALSO in NZ for at least 184 days in the 12-month period before that.

    So if INZ count backwards then if i have 184 days at the end of my first 12 months since my return and a further 184 days at the start of my 2nd 12 months do i qualify under the time in nz conditions?
    eg.
    1st 12 months 25/1/2019-24/1/2020 (184 Days since my Return)
    2nd 12 months 25/1/2020 - 28/7/2020 (184 Days since start of 12 Months)

    No, that's not how they count. Suppose you apply on 28/7/2020, you would need to show 184 days (at least) in NZ within the year running 28/07/2019 to 28/07/2020, then a further 184 days (at least) in the year between 28/07/2018 and 29/07/2019.
