    Default Newborn status in NZ

    Sorry if this has been asked in the past.

    I'm having a baby in a few months – I'm a British citizen with NZ residency and the father is British with NZ citizenship.

    Does this mean the baby will have NZ residency or NZ citizenship?

    Also, if anyone happens to know this too, does the baby get automatic British citizenship for having British parents despite being born in NZ?

    If the child is born in New Zealand, the child will definitely be a New Zealand citizen, owing primarily to your partner's NZ citizenship but also your NZ residency. The child will be a New Zealand citizen by birth. See Section 6 of the Citizenship Act 1977.

    If the child is not born in New Zealand, the child will be a New Zealand citizen only if your partner is a New Zealand citizen otherwise than by descent; in which case, the child will be a New Zealand citizen by descent. See Section 7 of the Citizenship Act 1977. If this is not the case, the child will not have New Zealand citizenship, and you'll have to apply for a Child of a New Zealander Visitor Visa to get your child into New Zealand, a Dependent Child Resident Visa once you are (re)settled in New Zealand, and eventually New Zealand citizenship by grant.

    A New Zealand citizen by descent cannot pass on New Zealand citizenship to a child born outside New Zealand. Note however that New Zealand citizens by descent may become New Zealand citizens by grant (and then they can pass on New Zealand citizenship to a child born outside New Zealand) by meeting the standard requirements for New Zealand citizenship by grant.

    Only if at least one of you is a British citizen otherwise than by descent -- in which case, your child will be a British citizen by descent. Similar to New Zealand's citizenship laws, a British citizen by descent cannot pass on British citizenship to a child born outside the United Kingdom.

    As Kelerei said your child will have New Zealand and British citizenship, wherever s/he will be born.
