    Default Boarder Exception

    Case on my uncle

    He had hold a Partnership of Resident Visa from offshore (oversea) on 20 Jan 2020, he hasn’t come to NZ landing . He don’t expect Covid-19 that cause his original plan first time landing to NZ delay and delay.

    INZ website change boarder terms frequently 。

    He now plan to NZ asap ( hopefully before Resident Visa expiry on 20/Jan2021.

    Who can come to New Zealand without requesting to travel

    a New Zealand citizen or permanent resident
    a resident with valid travel conditions, unless you got a resident visa outside New Zealand and you have never used it to travel here
    a partner or dependent child of a New Zealand citizen or resident, and your visa is based on this relationship
    a diplomat who holds a post in New Zealand.

    Under his situation does he need apply boarder exception before he first time landing to NZ?
    His wife NOW lives in NZ .

    Anyone can clarify on this situation?

    From what you say, your uncle comes under the third line here. He holds a visa as Partner of a New Zealander - his visa is based on his relationship. (If that is not the title of his visa, the situation could be different.)

    But he is second line also

    a resident with valid travel conditions, unless you got a resident visa outside New Zealand and you have never used it to travel here

    That why so confusing does he need to apply boarder exception or not?

    He got a RV outside NZ n never come to landing

    I went digging in the operational manual, and found this is covered by Y3.30(a)(ii): the partner of a New Zealand citizen or residence class visa holder covered by Y3.10(a), who has a visa based on their relationship to the New Zealand citizen or residence class visa holder, may be granted entry permission.

    From reading Y3.30, combined with the information on INZ's COVID-19 border closure page (which you already posted earlier), it looks as if only one of the options needs to be met -- but I would personally confirm with INZ themselves anyway before making travel plans.

    There's some potential good news in this regard. INZ has recently announced that offshore Resident Visa holders whose travel conditions are about to expire will be granted a 12-month visa extension, and those whose travel conditions expired on or after 2 February 2020 will be issued a second or subsequent Resident Visa valid for 12 months.
