Could I apply PR even if I am not in NZ physically?
Could I apply PR even if I am not in NZ physically?
Being absent from New Zealand does not affect your ability to lodge an application, but may (depending on your individual circumstances) affect your ability to meet the requirements (RV2.5) to be granted the visa.
Hi Kelerei,
Thanks for the info.
I think i will meet all the requirements. Coz i will be here 2 years continuously without leaving nz since i got my residence visa. My first time to leave nz will be this december. And i will make sure to complete the 2 years mark before I go on holiday.
Benz, please look at the detailed requirements at that link. Remember that INZ have to consider your presence in NZ, counting backwards from the exact date of your application. That means that, if you eventually apply after a long overseas visit, some of your early time in NZ will not count any more.
Yes: you may apply for a variation of travel conditions.
Yes. Here https://www.immigration.govt.nz/new-...anent-resident is another page on the same topics.
Posting on behalf of my wife.
She was granted her resident visa in June, 2021. Upon reading the info online on INZ website it states if you have a Tax Residency in NZ for 41 days in each you’re eligible to apply for a PR visa. She’s is a TAX resident for more then 41 days in both years. Can we apply for a Permanent Resident Visa NOW?
You must meet all criteria of RV2.5 to be granted a Permanent Resident Visa:
- you either:
- hold a residence class visa, and have held that residence class visa continuously for at least 24 months at the time of application; or
- have held a residence class visa in the three months before the application is made, and had held that residence class visa continuously for at least 24 months before it expired (provided RV1.25 does not apply); and
- your first day in New Zealand as a resident (R5.66.1 and/or R5.66.5) was at least 24 months before the application is made; and
- your can demonstrate a commitment to New Zealand (refer to RV2.5.5 if your intention is to demonstrate a commitment to New Zealand by tax residence status in New Zealand); and
- you have met any conditions imposed under section 49(1) or section 50 of the Immigration Act; and
- you continue to meet character requirements for residence (see A5).
Applying before June 2023 will result in you not meeting RV2.5(a) and RV2.5(b), and INZ must therefore decline your application.
Agreed. Saying this another way, tax residency (as a demonstration of commitment to NZ) is only ONE among the conditions for PR, and an applicant must meet ALL of them.
