    Default Partnership Visa

    Hi team, have a question here since the lady on INZ line was quite unsure. My partner currently hold a partner sponsorship visa with me ( Nz citizen ). Her visa (valid for 2 years) is running out this Oct and wonder if she can apply for another partner visa again ? and also if she had done her medical certificate on Dec, 2020 will it still be valid for this application? TIA team

    You can only have this visa for 2 years, but before it expires you can apply for residence based on your partnership.

    However, bear in mind that if she gets an application for Residence in now, and has heard nothing when she gets to within, say, two weeks of the expiry of her existing visa, it would be sensible to ask INZ if it's likely to be through in time, as, IF NOT, she would need to apply for another partner-sponsored work visa, so that an Interim visa can be issued to make her legal during any further waiting time. (Asking about this very commonly triggers prompt issue of the residence visa, we have seen.) Interim visas can only be issued for temporary visas, NOT residence visas.

    Applicants for a residence class visa may provide a Medical Certificate and Chest X-ray Certificate, which was issued more than three months before the date that their application is made, if:

    they have provided a Medical Certificate and Chest X-ray Certificate with an earlier visa application; and
    they were assessed as having an acceptable standard of health based on those certificates; and
    those certificates were issued less than 36 months prior to the current application.

    Thank JandM !! thank you so much for your swift reply ! so on that question, if she doesnt want to apply for residency straight away due to other commitments ( trave, family …etc ) can she still be able to apply for partner work visa without apply for partner residency? thank you so much for your time !!!

    No. A further Work Visa for partners of New Zealand citizens may not be granted beyond 24 months from the date the first partnership-based visa was granted (see WF2.1). In practice, INZ has in the past made an exception to this instruction if the partner has applied for a partnership-based residence class visa, and a further Work Visa is required to allow the partner to remain in New Zealand legally while the residence class visa is being processed.

    If a further Work Visa is desired, but there is no current intention to apply for a residence class visa, your partner would need to meet the criteria for an employment-based Work Visa (e.g. the Accredited Employer Work Visa) in their own right. Note, however, that a stand-down period for this visa will shortly be introduced, so no matter your actions, ultimately your partner would have to choose between applying for a residence class visa or leaving New Zealand.

    Completely agree with Kelerei. Notice, it's INZ who can decide to do this, for THEIR purposes, and the applicant doesn't have the choice.

    Thanks team !! and last question i promise !! if she apply for her residency will she be able to travel outside NZ while waiting for decisions?

    This will entirely depend on the travel conditions on her existing (and new, if she needs one) temporary entry class visa.

    Note, however, that if she needs a new partnership-based Work Visa to keep her legally in New Zealand while the partership-based Resident Visa is being processed, and an Interim Visa needs to be granted between the old Work Visa expiring and the new Work Visa being granted, that Interim Visa will not have travel conditions (see I1.20.1(e)). Travelling out of New Zealand on an Interim Visa will, therefore, result in an inability to return until the further visa applied for is granted.
